Acceptance of Terms

By accessing and using the LabStart website, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with these terms, please do not use this website.

Use of LabStart Marks

LabStart grants you a non-exclusive, non-transferable, royalty-free, and fully paid-up right and license to display LabStart’s trademarks, logos, trade names, business names, domain names, and service marks (collectively, the “LabStart Marks”) in connection with publicizing your involvement with the LabStart Program. This includes using the LabStart Marks on your website and in printed marketing materials. Your use of the LabStart Marks is subject to limitations, restrictions, or prohibitions that LabStart may communicate to you in writing, and you must cease using the LabStart Marks immediately upon LabStart’s written notice.

Indemnification

You agree to indemnify and hold LabStart and its affiliates and their respective directors, managers, officers, employees, consultants, volunteers, agents, and equity holders (collectively, the “LabStart Parties”) harmless from all liabilities, claims, demands, expenses, fees, fines, penalties, suits, proceedings, actions and causes of action, and damages (inclusive of attorneys’ fees) of any kind and nature arising out of or connected with your use of the website or participation in the LabStart Program.

Limitation of Liability

You acknowledge that you are solely responsible for your success and agree that neither LabStart nor any of the other LabStart Parties shall have any liability to you or any person asserting claims on your behalf in connection with the services provided by LabStart or any other matter referred to in these Terms of Use.

Governing Law; Arbitration

These Terms of Use will be governed by and construed under the laws of the State of California without regard to conflicts of law principles. Any claim or controversy arising from or related to these Terms of Use or breach thereof shall be settled by mandatory arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The place of arbitration shall be San Francisco, California.

Changes to Terms of Use

LabStart may revise these Terms of Use at any time without notice. By using this website, you are agreeing to be bound by the then-current version of these Terms of Use.
